Article 2 All units and individuals engaged in the planning, construction, maintenance, management, supervision and use of urban lighting facilities in urban planning areas of this Municipality must abide by these Measures.

Article 3 Urban lighting as referred to in these Measures is a general term for urban functional lighting and landscape lighting. It mainly refers to roads, streets, residential areas, bridges, tunnels, and public parking lot parks and green buildings and buildings in urban planning areas. Functional lighting and landscape lighting and its associated auxiliary power distribution room, transformer, distribution box, underground and underground pipelines, light poles, lamps, working wells, monitoring systems and other equipment.

Article 4 The municipal administrative department in charge of the city shall be in charge of the city's urban lighting management work, and the municipal lighting management agency shall be responsible for the daily management of urban lighting.
Departments and units such as construction, planning, gardening, quality and technical supervision, power supply, city appearance and environmental sanitation, and urban management law enforcement shall do their best in urban lighting management within their respective functions and responsibilities.

Article 5 The special plan for urban lighting shall be incorporated into the overall urban planning.
The urban lighting special plan shall be organized and prepared by the municipal planning administrative department in conjunction with the municipal municipal administration and other relevant departments. After the argumentation and review, it shall be implemented after being approved by the municipal people's government.
The municipal administrative department of municipality shall, according to the special plan for urban lighting, formulate an annual plan for urban lighting, which shall be implemented after being approved by the municipal people's government after being balanced by the municipal administrative department of construction.

Article 6 Urban lighting planning and construction shall conform to the urban lighting standards and standards formulated by the State and Shengcheng City.
Units that undertake urban lighting design, drawing review, construction, supervision, and maintenance must have corresponding qualification levels.

Article 7 The urban lighting part of the urban infrastructure construction and renovation project invested or organized by the government shall be guided by the municipal municipal administrative department to organize the implementation.
Encourage social forces to participate in the construction of urban lighting facilities in the form of sole proprietorship, joint venture, and cooperation.

Article 8 The design plan for urban lighting project projects shall conform to the special plan for urban lighting and implement the expert argumentation system.
The design plan for the urban lighting project shall be submitted to the municipal municipal administrative department for the record after approval by the relevant department of the municipal government.

Article 9 Government investment and urban lighting projects based on government investment shall be subject to bidding in accordance with relevant regulations.

Article 10 If new or renovated urban infrastructure and other construction projects are to be installed in accordance with the urban lighting special plan, it shall be designed, constructed, and accepted and delivered at the same time as the main project. The supporting funds shall be included in the project investment estimate. .

Article 11 Urban lighting products and materials used shall be inspected and qualified by the quality and technical supervision department to ensure that the materials are environmentally friendly and energy-saving before they can be put into use.

Article 12 Supports such as power poles that meet the conditions of urban lighting facilities may be used without affecting their functions and traffic, and relevant units shall provide support.

Article 13 After completion and acceptance of the urban lighting project, the construction unit shall, within 15 days, go to the municipal municipal administrative department for the record. The municipal municipal administrative department shall inform the municipal construction administrative department of the filing status every year.

Article 14 The maintenance and management of urban lighting facilities shall adhere to the principle of safety first, energy saving and high efficiency, and ensure that the urban lighting facilities are intact, clean and beautiful.

Article 15 The municipal lighting management agency shall, according to the actual situation, stipulate a reasonable time for opening and closing lights.
Anyone who needs to adjust the time of opening and closing lights in case of major activities shall be coordinated and implemented by the municipal municipal administrative department after approval by the municipal people's government.

Article 16 The departments or units undertaking urban lighting management shall strengthen the daily maintenance and management of urban lighting facilities to ensure that the urban lighting facilities are in good condition, safe and normal operation, and the lighting rate shall meet the national standards.

Article 17 Units that undertake maintenance of urban lighting facilities shall strictly implement urban lighting regulations and standards to ensure the quality of maintenance.

Article 18 The funds required for urban functional lighting and public facilities landscape lighting shall be included in the financial budget to ensure the normal expenditure of maintenance funds and electricity charges.

Article 19 The government may grant certain preferential policies for the construction of social forces and the landscape lighting for its own maintenance and management.

Article 20 Functional lighting and public facilities landscape lighting (excluding residential areas) invested by the government and social forces under the jurisdiction of the municipality shall be gradually transferred to the municipal urban lighting management agency for management; if not handed over, the construction or property rights unit shall promptly maintain or press The regulations require modification; if the handover is required, the following conditions shall be met:
(1) Comply with the special plan for urban lighting;
(2) The corresponding approval procedures have been completed in accordance with the law;
(3) Compliance with urban lighting standards and standards;
(4) Compliance with technical standards incorporated into urban lighting networks;
(5) Having a standardized and complete urban lighting project file;
(6) Providing necessary maintenance and operating conditions;
(7) Compliance with the quality warranty;
(8) Paying 1-3 years of operation and maintenance costs.

Article 21 The completed urban lighting facilities shall be updated or modified according to relevant norms and standards to ensure the lighting effect and safe and stable operation of the facilities.

Article 22 When the municipal administrative department in charge of the city cooperates with relevant departments to supervise and manage the construction activities involving urban lighting, it shall mainly supervise the following contents:
(1) Comply with the special plan for urban lighting;
(2) Comply with urban lighting standards and standards;
(3) The design, construction, supervision and maintenance units have corresponding qualifications;
(4) Special operations and supervision personnel have special operation operation qualifications and corresponding professional management qualification certificates;
(5) Having complete and complete urban lighting project completion files and daily management materials;
(6) Other conditions stipulated by laws, regulations and rules.

Article 23 The trees in the vicinity of urban lighting facilities shall meet the safety distance from the charged objects. Trees that are not in conformity with the safety distance standard and affect the lighting effect due to natural growth shall be pruned by the municipal urban lighting management agency in consultation with the municipal gardening and greening management department; If the tree is seriously jeopardized by the force majeure, the city lighting management agency may take emergency measures to pruning, notify the city's landscaping management department, and go to the city's landscaping management department to complete the formalities within 10 days after the danger is removed. .

Article 24 If it is really necessary to erect cables, install other facilities or use urban lighting power sources in urban lighting facilities, it shall be implemented in advance in accordance with the city lighting regulations and standards in consultation with the municipal lighting management agencies.

Article 25 If it is necessary to dismantle, relocate or modify urban lighting facilities, or may affect the urban lighting facilities in good condition and safe operation during construction, the city's urban lighting management agency shall be consulted in advance to arrange the operating units with corresponding qualifications to the relevant cities. Lighting facilities are removed, moved, altered or protected. The required cost is borne by the merchant.
If emergency measures such as rescue and disaster relief urgently require measures such as dismantling, relocation, and alteration of urban lighting facilities, they are not subject to the provisions of the preceding paragraph. However, the competent department of emergency rescue and disaster relief shall promptly notify the municipal lighting management agency.

Article 26 Any unit or individual that damages urban lighting facilities shall properly protect the scene of the accident, prevent the accident from expanding, and immediately notify the municipal lighting management agency.

Article 27 Urban lighting facilities are urban infrastructure. Any unit or individual has the obligation to protect, and the following acts that damage urban lighting facilities shall not be implemented:
(1) Coating, marking, engraving, writing and drying clothes on urban lighting facilities;
(2) arbitrarily planting trees, digging pits and borrowing soil, constructing buildings, stacking objects, setting other objects or dumping corrosives within the safe distance of urban lighting facilities;
(3) Unauthorized use of urban lighting facilities to post, hang, set up publicity materials and advertisements;
(4) erecting communication cables, installing other facilities or using power sources on urban lighting facilities without authorization;
(5) Unauthorized dismantling, migrating and altering urban lighting facilities; (6) Other acts that may affect the normal operation of urban lighting facilities.

Article 28 The municipal municipal administrative department may commend and reward the units and individuals that have made outstanding achievements in the management of urban lighting and reported violations of the provisions of these Measures.

Article 29 Anyone who commits one of the following acts in violation of these Measures shall be ordered by the municipal administrative administrative law enforcement department to make corrections within a time limit and may be fined not less than 1,000 yuan but not more than 5,000 yuan:
(1) failing to obtain the corresponding qualifications for urban lighting design, drawing review, construction, supervision and maintenance, and undertaking urban lighting design, drawing review, construction, supervision and maintenance;
(2) failing to design, construct, supervise and maintain according to urban lighting regulations and standards;
(3) The urban lighting project design plan has not been approved or implemented according to the approved design plan;
(4) The urban lighting project has been delivered without authorization due to unqualified inspection or acceptance.

Article 30 Anyone who violates the provisions of Article 27 of these Measures shall be ordered by the municipal administrative administrative law enforcement department to make corrections within a time limit, and may impose a fine of not less than 200 yuan but not more than 5,000 yuan depending on the seriousness of the case; if the loss is caused, the liability shall be compensated according to law. .

Article 31 If one of the following acts is violated in accordance with these Measures, the municipal administrative administrative law enforcement department shall order it to make corrections within a time limit; if it fails to change within the time limit, it shall be fined not less than 200 yuan but not more than 1,000 yuan:
(1) The urban lighting project design plan has not been filed as required;
(2) The pattern, text and lighting of the urban lighting facilities are incomplete or dirty, obsolete and damaged;
(3) Failure to start or close the city lighting according to the prescribed time.

Article 32 Whoever steals or destroys urban lighting facilities shall be punished by the public security department in accordance with the Law of the People's Republic of China on Public Security Administration Punishment; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 33 If a party refuses to accept the decision on administrative punishment, it shall file an administrative reconsideration or an administrative lawsuit according to law.

Article 34 If the staff of the municipal municipal administrative department and the municipal lighting management agency and other departments and units neglect their duties, abuse their powers, or engage in malpractices for personal gains, they shall be given administrative sanctions by their units or the competent department at a higher level; Be held criminally responsible.

Article 35 The county (city) city lighting management shall be implemented in accordance with these Measures.

Article 36 The municipal municipal administrative department in charge shall be responsible for the interpretation of the problems in the specific application of these Measures.

Article 37 These Measures shall come into force on October 1, 2006.
