Seoul Semiconductor filed a complaint with the US International Trade Commission (ITC) to file a complaint against Nichia for unfair trade practices.
Seoul Semiconductor announced that it filed a complaint with the United States International Trade Commission (ITC) and filed a complaint against Nichia Chemical Industries Co., Ltd. (Nichia Corporation or Nichia Corporation) for unfair trade practices. Seoul Semiconductor accused Nichia's import and sale of gallium Nitride-containing laser diodes infringing on the US patent number of Seoul Semiconductors Number: 5,321,713 ('713).
Seoul Semiconductor is a US university and company that has invested more than $10 million in research and development related to laser diodes and light-emitting diode (LED) technology. From these R&D investments, Seoul Semiconductor has successfully obtained a number of patents related to laser diodes and LEDs, including the US '713 patent rights, which complements Seoul Semiconductor’s own strong patent portfolio, enabling Seoul Semiconductor Has more than one thousand patents.
In addition, Seoul Semiconductor is suing for the infringement of LED products sold by Nichia Corporation to maintain another US patent, number 5,075,742 ('742). The lawsuit was filed on November 6, 2007, in the US District Court in the eastern part of Texas, and the case is pending. U.S. '742 patent related to the coverage of white, blue, green and UV laser diodes and LED technology.
Seoul Semiconductor expects ITC to conduct an investigation into Nichia Corporation in January next year and will conduct trials in the fall of 2008.
